Conditions of Use
1. Scope
STS srl acts in the field of special purpose machines and fixture construction for home users (consumers). The General Terms and Conditions (GTC) presented on this page define the business relationship between you (customer/buyer) and STS srl in the version valid at the time of your order. Other conditions are only valid if they have been accepted by us in writing. Please read these terms carefully before you place an order. By placing an order at STS srl you agree that your order will be subject to these conditions.
2. Contractual Agreements
STS srl concludes contracts with customers who are unlimited contractually capable natural persons over the age 18 years as well as with legal persons. Your order in our online-shop constitutes an offer to conclude a purchase contract. If you place an order, we will send you an e-mail that confirms the receipt of your order and its details (order confirmation). This order confirmation does not constitute acceptance of your offer, but is only intended to inform you that your order has been received. A contract is only concluded when we ship the product to you and confirm the shipment to you in a further e-mail (shipping confirmation).Furthermore we also accept orders via e-mail, fax or letter (in exceptional cases also via telephone). These orders only constitute an offer to conclude a purchase contract. The contract is concluded when we send you a confirmation in writing which affirms the reception and the acceptance of your order (order acceptance confirmation).
3. Prices
The currency of all prices is EURO, gross (inclusive of 22% VAT) and plus additional shipping fee. The shipping fee you find on our homepage under: "Shipping and Returns”. Export shipments outside of the EU can cause additional customs duty, taxes and charges we have no influence on. These costs have to be paid by the buyer. We reserve the right to adjust prices if technical adjustments are made to the product at your request between the time of the offer and the time of contract fulfilment. Offers are not binding, especially in brochures that do not record any expiration dates.
4. Payment terms and retention of title
The invoice amount is payable in advance using the payment methods listed in the online shop.

-Payment in advance via PayPal (The PayPal fee is to be paid by the customer: 3 % of the total amount .
All products remain the property of STS srl until payment has been completed in full.
5. Delivery
Unless otherwise agreed, delivery shall be made to the address specified by the purchaser in our online-shop.

On the website you can find information about the availability and the current delivery time of our products (in the particular description of the articles). We would like to draw your attention to that fact that all information concerning availability, shipment or delivery of a product are only estimated times and approximate values. They do not constitute binding deadlines nor guaranteed shipping or delivery dates. If we note while processing your order that you ordered products are not available, you will be notified separately by e-mail. The statutory rights of the buyer are not affected.
We deliver your order generally as an insured parcel. Uninsured modes of shipment we only choose on explicit wish of the buyer.
If you order products for delivery outside of the EU, they may be subject to customs and taxes. Any additional charges for customs clearance must be paid by you.
6. Guarantee and warranty
Despite extensive testing, it cannot be excluded that our products may occasionally present defects. Damage can also occur in transit, so please check the packaging when accepting a delivery. In the eventually case of defects we reserve our right of rectification. Guarantee: If our products are re-sold during this period, the claim under guarantee devolves to the new owner. The claim under guarantee has to be proofed with the original invoice.
Warranty: In contractual agreements with non-merchants (end customers) we provide a defect-free warranty for two years after delivery. In contractual agreements with merchants (between companies) we provide a one-year defect-free warranty.
The warranty is valid for the first buyer only! The warranty claim has to be proofed by the customer.
7. Liability and defects
Customers must submit a written communication of any defects within 10 days of receiving the purchase at their destination of choice. This applies to non-retail customers only for obvious defects. Any such complaints will only be taken into account if the goods are still in the same state they were in at delivery.We will accept the return of merchandise that we acknowledge to be defective, and we will offer a non-defective replacement. Instead, we can offer compensation for the reduction in value of a defective product. If a repair or a replacement delivery fails, non-retail customers have the right to request a reduction of purchase price or the cancellation of the purchase contract.
Further claims of consequential damages on the part of the buyer are excluded unless they are based on a defect covered by the warranty. The buyer must allow reasonable time and opportunity for the supplier for the correction of faults. If he refuses, then the supplier is exempt from responsibility due to defects.
A return of defective goods is only to be performed with our consent and in the original packaging or equivalent packaging. Freight costs are to be covered by the buyer. A refund will only take place in case of a justified complaint. Our liability, regardless of the legal reason, is limited to intent and gross negligence.
Any technical advice given will be to the best of our knowledge. All specifications and information available concerning suitability and application of our products are non-binding and do not exempt the buyer from performing their own tests and trials.
The buyer is himself responsible for compliance with all laws and regulations regarding the use of the goods. For suitability of the product for specific purposes, we are only liable if it is expressly guaranteed in writing.
We point out, that our products are to be used only in the field of hobby-milling/drilling/etc. or for the production of single parts or small serial production, but not in the field of professional long-term usage or industrial production!
The guarantee and liability assured by STS srl are limited to damages that demonstrably occurred as a result of defective material, faulty design or poor execution.
Damage due to natural wear and tear, insufficient maintenance, failure to observe assembly instructions or operating instructions, excessive, unsuitable or incorrect usage, as well as other reasons that STS srl does not provide for are explicitly excluded.
In no case can the buyer claim compensation for damage not caused to the delivered goods themselves, like for example loss of production, loss of use, loss of orders, lost profit and other direct or indirect damage.
8. Changes to the terms and conditions
We reserve the right to make changes to our website, rules and regulations, including these terms and conditions at any time. Your order is subject to all sales conditions, contractual conditions and general terms and conditions that are in effect at the time of order, unless changes to these conditions are required by regulations or legal reasons. If any rule in these terms and conditions is invalid, void or unenforceable for any reason, this rule will deemed severable and will not affect the validity and enforceability of the remaining positions.
9. Applicable law and jurisdiction
Italian law applies, excluding the UN Sales Convention (CISG). The legal domicile for the supplier and the buyer is Iserlohn, Italy.
